1. ABOUT STYRON PHOTO

Styron Photo provides photography and videography services and may sell physical goods such as prints, wall art, merchandise/apparel, and digital goods such as downloadable images or media, where offered (collectively, “Products” and “Services”).

2. ELIGIBILITY & ACCEPTABLE USE

By using this Website, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into binding agreements.

You agree not to:

Attempt to gain unauthorized access to the Website or systems

3. ORDERS, BOOKINGS, AND PAYMENTS

All orders and booking requests are subject to acceptance and availability. We may refuse or cancel any order for any reason, including suspected fraud, incorrect pricing, or product availability.

3.3 Payment

4. SERVICES: SCHEDULING, WEATHER, AND CLIENT RESPONSIBILITIES

4.1 Scheduling

Photography and video services require scheduling. Times are not guaranteed until confirmed by us in writing (email/text is acceptable).

4.2 Client Responsibilities

You are responsible for ensuring:

Property access is available at the scheduled time
The property is ready (cleaned, staged, lights working, etc.)
Any special restrictions are disclosed in advance (HOA rules, parking, gate codes)

4.3 Weather & Outdoor Work

Weather conditions (rain, wind, lighting, surf conditions, flight restrictions, etc.) may affect scheduling and results. We may reschedule outdoor or drone work at our discretion for safety and quality.

4.4 Drone Services

Where drone/aerial services are offered, you acknowledge that flights may be restricted by:

FAA regulations
Temporary flight restrictions (TFRs)
Weather and wind conditions
Local hazards or access limitations
If aerial capture is not possible, we may provide alternatives or reschedule when possible.

5. DELIVERY, TURNAROUND TIMES, AND REVISIONS

5.1 Delivery

Deliverables may be provided digitally via download link, gallery link, email, or other agreed method.

5.2 Turnaround Times

Typical turnaround times may be posted on the Website or communicated at booking. All turnaround times are estimates and may vary due to volume, weather delays, travel, or circumstances outside our control.

5.3 Revisions

If revisions are offered, they are limited to reasonable adjustments consistent with the purchased scope (e.g., basic edits, exposure, color correction). Requests that require extensive retouching or re-editing may incur additional fees.

6. SHIPPING, PRINTS, WALL ART, AND PHYSICAL PRODUCTS

6.1 Shipping

If physical products are shipped, shipping costs and delivery estimates will be displayed at checkout. We are not responsible for carrier delays.

6.2 Color and Display Differences

Colors may vary due to monitor calibration, lighting, printing methods, and materials. By purchasing prints or wall art, you understand results may differ slightly from on-screen previews.

6.3 Damaged Items

If your item arrives damaged, contact us within [3–7] days of delivery with photos of:

The damage
The packaging
The shipping label
We will work with you to resolve the issue (replacement or refund where applicable).

7. RETURNS, REFUNDS, AND EXCHANGES

Return rules may vary depending on product type.

7.1 Custom Prints and Custom Products

All custom prints, wall art, and made-to-order items are final sale unless they arrive damaged or defective.

7.2 Apparel (If Sold)

Unworn and unwashed apparel may be eligible for return or exchange within [14–30] days of delivery, subject to our Return Policy.

7.3 Digital Products

All digital downloads and digital deliverables are non-refundable once delivered or accessed, unless required by law.

7.4 Services

Service fees, retainers, and deposits may be non-refundable depending on the scope and timing. Any cancellations must be submitted in writing.

8. INTELLECTUAL PROPERTY & LICENSING (VERY IMPORTANT)

8.1 Ownership

All photographs, videos, edits, previews, media, and creative work produced by Styron Photo remain the exclusive property of Styron Photo and are protected by copyright laws.

8.2 License to Client

Unless otherwise agreed in writing, upon full payment we grant you a limited, non-exclusive, non-transferable license to use the delivered content for its intended purpose.

You may not:

Sell, sublicense, or transfer the images/videos to third parties (unless permitted)
Remove watermarks from previews
Claim authorship or register copyright ownership
Use the content for unlawful, defamatory, or misleading purposes

8.3 Commercial Use

Commercial usage (including real estate marketing, branding, advertising, or business promotion) must be explicitly licensed. If commercial rights are included in your purchase/package, those details will be described in your invoice, quote, or booking confirmation.

8.4 Unauthorized Use

Unauthorized use of images/videos may result in:

License termination
Invoicing at our standard commercial usage rates
Legal action where applicable

9. CLIENT-SUPPLIED MATERIALS

If you provide logos, floor plans, reference images, or any materials, you confirm you have the legal right to use and provide them. You agree to indemnify us from claims arising from your materials.

10. MODEL RELEASES & PROPERTY RELEASES

Clients are responsible for obtaining any necessary permissions to photograph:

People on site (if required)
Private locations
Restricted areas
Trademarked or copyrighted items when necessary

If a project requires a model release or special permissions, it must be discussed in advance.

11. PORTFOLIO USE & PROMOTIONAL RIGHTS

Unless you request otherwise in writing before the shoot or purchase, you grant Styron Photo permission to use delivered or captured content for:

Portfolio use
Social media
Website marketing
Sample galleries
Advertising

If you need full confidentiality, request it prior to booking.

12. THIRD-PARTY LINKS & SERVICES

The Website may contain links to third-party sites or services. We are not responsible for third-party content, policies, or practices.

Payments may be processed by third-party providers. Your use of those services is also governed by their terms.

13. DISCLAIMER OF WARRANTIES

The Website, Products, and Services are provided “as is” and “as available.” We do not guarantee that the Website will be error-free, uninterrupted, or free from viruses or harmful components.

To the maximum extent permitted by law, we disclaim all warranties, express or implied.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Styron Photo will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, business interruption, or reputational harm arising out of your use of the Website, Products, or Services.

Our total liability for any claim will not exceed the amount you paid us for the specific order or service giving rise to the claim.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Styron Photo and its owners, employees, contractors, and affiliates from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from:
